Who you are contracting with
This service is provided by Pithy, LLC (“Pithy”, “we”, “us”), a limited liability company registered in TKTK-STATE with its principal place of business at TKTK-REGISTERED-ADDRESS. When these terms say “you”, they mean the person or company using the service. If you are agreeing on behalf of a company, you confirm you have authority to bind it. If you are agreeing as an individual, you confirm you are of the age of majority where you live.
You are contracting with Pithy, LLC for the service. You are not contracting with us for the purchase — see Payment, tax and renewal below, which explains the part Paddle handles.
What the service is
Pithy is a backend kit for Cloudflare. You install packages into a Worker that runs in your own Cloudflare account, and you may also use a hosted dashboard we operate to connect to and observe those Workers. “Service” in these terms means the packages, the command-line tool, the dashboard, the documentation, and this website.
The distinction matters throughout: the Workers, databases, buckets and indexes belong to you and run in your account. The dashboard is ours and runs in ours.
Accepting these terms
By creating an account, installing the packages, or continuing to use the service, you agree to these terms. If you do not agree, do not use the service.
We may change these terms. If a change is material we will give notice — in the dashboard, by email to the address on your account, or both — before it takes effect. Continuing to use the service after a change takes effect means you accept the revised terms. The effective date at the top of this page is the date the current version applies from.
Your account
You are responsible for keeping your credentials confidential and for everything done under your account, whether or not you authorized it. Tell us promptly at support@help.pithy.sh if you believe your account has been compromised.
Information you give us — your name, your email address, your billing details — must be accurate, and you must keep it current. We rely on it to reach you about your account, and mail we cannot deliver is a problem that eventually becomes yours.
What you may not do
You must not misuse the service. In particular, you must not:
- use it for anything unlawful, or to help anyone else do anything unlawful;
- use it to send spam, run fraud, or misrepresent who you are;
- infringe anyone’s intellectual property, privacy or other rights;
- interfere with the security or integrity of the service, which includes:
- introducing malware or any other harmful code;
- probing, scanning or testing the vulnerability of any system or network we operate, without our prior written permission;
- scraping, harvesting or bulk-extracting data by automated means beyond what the documented interfaces allow;
- circumventing rate limits, quotas, authentication or any other technical restriction;
- resell, sublicense or redistribute the hosted dashboard as a service to third parties;
- reverse engineer the hosted dashboard, except to the extent that restriction is unenforceable where you live.
The open-source packages are licensed separately and their license governs what you may do with the code. Where that license grants you a right, it wins over this section.
What we own, and what you own
Most of what you install from us is open source, and these terms do not take that back.
The packages, core and the command-line tool are released under the MIT License, and the audit capability under the Functional Source License, which becomes MIT two years after each release. Those licenses are what grant you your rights in that code. Where a license grants you something, it wins over this section — nothing here narrows it, and nothing here is a condition on it. See the License page for which is which.
What is not open source, and what we keep: the hosted dashboard, this website, and the Pithy name, wordmark and branding. We also retain the copyright in the open-source code — an open-source license is a grant, not a transfer — so the code stays ours and your rights in it stay yours.
You own your content. That means your application, your configuration, your data, and everything your Workers store in your own Cloudflare account. We claim no ownership of it and no license to it beyond what is described here.
To operate the dashboard we process a limited amount of information about your account and your connections — enough to show you what you asked to see. We describe exactly what, and why, in the Privacy Notice. You grant us permission to process that information for the purpose of providing the service, and for no other purpose.
What we promise, and what we do not
We will provide the service with reasonable skill and care. That is the promise, and it is the only one.
We do not guarantee that the service will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that it will meet your requirements. We do not offer a service level agreement or an uptime commitment. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
Your Workers run in your own Cloudflare account and do not depend on the dashboard to serve traffic. If our dashboard is unavailable, your application keeps running. That is a property of the architecture rather than a commitment we are making, but it is worth knowing which outages can reach you.
Payment, tax and renewal
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.
That divides responsibility along one line: Paddle owns the transaction, we own the product. Paddle collects the payment and any sales tax, issues the receipt and the invoice, holds the payment method, and handles refunds and chargebacks. Everything about the service itself — what it does, why it is not doing it, and any question you would put to a person — is ours, at support@help.pithy.sh.
You buy and cancel inside our app rather than on a page of Paddle’s, but the money is still theirs to move, which is why a refund goes through them however the purchase was made.
Because Paddle is the merchant of record, the commercial terms of your purchase — the term and its renewal, cancellation, fees, payment methods, taxes and billing frequency — are governed by Paddle’s Checkout Buyer Terms, which you accept at checkout.
Refunds are covered by our Refund Policy.
Downgrading, suspending, and ending access
Canceling a paid plan does not end your account
Canceling moves you down to Free, it does not close anything. Your paid plan runs to the end of the period you have already paid for, and at that point the account continues on the Free tier with whatever Free includes.
You can cancel in two places, and they do the same thing: the billing screen in your dashboard, or Paddle directly at paddle.net. Neither requires you to ask us, and either way the change takes effect on the date shown before you confirm it.

Closing your account entirely
Write to support@help.pithy.sh and we will close it and delete the records we hold on the schedule in the Privacy Notice.
When we may suspend or terminate
We may suspend or terminate your access to the hosted dashboard if:
- you materially breach these terms and, where the breach can be fixed, do not fix it within 14 days of us asking;
- a payment fails and is not recovered — which ends the paid plan and moves you to Free, and only closes the account if nothing else on this list applies;
- we reasonably believe your use presents a security or fraud risk to us, to another customer, or to the public;
- you repeatedly or seriously violate the restrictions in What you may not do; or
- we are required to by law.
Where the circumstances allow it we will warn you first. Where they do not — an active security incident, for instance — we will act first and tell you promptly afterward.
What happens when access ends
This section is about termination, not about canceling a paid plan — canceling leaves you on Free with an account that still works.
When access does end, your access to the hosted dashboard stops. Your Workers, databases, buckets and indexes are unaffected, because they are in your Cloudflare account and we cannot reach into it: nothing of yours needs exporting, because nothing of yours is held by us in the first place.
We delete the account and connection records we hold on the schedule set out in the Privacy Notice. The open-source packages you have already installed remain yours to use under their license.
Liability
Nothing in these terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or anything else that cannot be limited by law.
Subject to that, neither party is liable for indirect, incidental, special or consequential loss, or for loss of profits, revenue, goodwill, or data, however caused.
Subject to that, our total aggregate liability arising out of or in connection with these terms is limited to the total fees you paid us in the twelve months before the event giving rise to the claim. Where you have paid us nothing, our aggregate liability is limited to one hundred United States dollars.
Your indemnity
You will indemnify us against claims, damages and reasonable costs arising from your content, your use of the service in breach of these terms, or your unlawful use of the service.
General
Governing law. These terms are governed by the laws of TKTK-STATE, United States, without regard to its conflict of laws rules.
Disputes. The state and federal courts located in TKTK-STATE have exclusive jurisdiction over any dispute arising out of these terms, and both of us submit to that jurisdiction.
Assignment. You may not assign these terms without our written consent. We may assign them in connection with a merger, acquisition or reorganization.
Force majeure. Neither of us is liable for failing to perform because of events beyond our reasonable control — natural disaster, war, civil unrest, pandemic, or the failure of a utility or upstream provider. This does not excuse an obligation to pay.
Severability. If a provision is held unenforceable, the rest stays in force and the unenforceable provision is limited to the minimum extent necessary.
Entire agreement. These terms, the Refund Policy, the Privacy Notice and Paddle’s buyer terms are the whole agreement between us about the service.
Waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
